PLEASE READ THIS PRIVACY POLICY CAREFULLY. BY ACCESSING OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS PRIVACY POLICY.
This Privacy Policy (this "Privacy Policy") explains the information we collect, how we use and share it, how to manage your privacy controls, and your rights in connection with our website located at fanfeed.ai (the “Site”), the FanFeed mobile application (the “App”), and any content, tools, features, and functionality offered on or through them (collectively, the "Services"). The Services are operated by FanFeed LLC (“FanFeed,” “we,” “us,” or “our”). For purposes of this Privacy Policy, "Personal Information" means any information relating to an identified or identifiable individual.
We update this Privacy Policy from time to time, so please review it regularly. If we make material changes, we will use commercially reasonable efforts to notify you before the revised policy takes effect by posting the revised policy on the Services and, where appropriate, notifying you by email or in-app alert. Your continued use of the Services after the effective date of any update constitutes your acceptance of the updated Privacy Policy. Terms not otherwise defined in this Privacy Policy have the meaning given to them in our Terms of Service.
1. PERSONAL INFORMATION WE COLLECT
We collect information about you, including information that directly or indirectly identifies you, if you or other FanFeed users choose to share it with FanFeed. The sources from which we collect this Personal Information fall into three categories: information you provide, information we collect automatically, and information we collect from other sources. FanFeed also collects information about how you use the Services.
The categories of Personal Information we collect are described in the table below.

We do not use PostHog to capture raw text field contents, image or photo pixels, keystrokes, clipboard contents, precise location, contacts, or any data collected in the background or while the app is off-screen. 2. PHOTO SCANNING AND CAMERA ROLL ACCESS
This section describes our practices with respect to photos you grant us access to, which is one of the core functions of the FanFeed platform.
How We Access and Scan Your Photos. When you onboard to FanFeed and as you continue using the Services, we will scan photos that you grant us access to through your camera roll or through manual upload. When you grant us access to your camera roll, you may choose to allow full access or to limit access to selected media. After you grant access or upload photos, FanFeed begins to process the selected media to determine which photos are "event photos" (i.e., those that can be tied to a specific live event) and otherwise to generate insights and inferences as described below.
You agree that we will process information associated with your selected media, including precise location and other metadata, to help us understand and generate inferences about your event- and non-event-related activities and interests, provide the Services, and let you know about events, promotions, and partnerships you may be interested in.
What We Collect from Your Photos. When you grant us access to your photos, we collect and process the following categories of information:

Persistence of Photo Information. All photo information we collect is persisted. As our models and other data capabilities improve over time, we may generate additional inferences of the same types described in this Section 2 from photos we have already collected. If we intend to generate materially new categories of inferences not disclosed at the time of collection, we will provide you with notice and, where required by applicable law, obtain your consent before doing so.
Public and Private Sharing of Photo Content. All photo content (actual image content) is considered private until you explicitly post it publicly. When you post to the public global feed, you will receive a clear in-app notice that the content is being uploaded to a global feed viewable by all users. We also offer group/private shared albums: a private feed is created for groups of users who have marked themselves as attending an event together. Think of this as a shared album to which invited users are added. All members of the group may upload to and view that shared album.
Sensitive Nature of Photo Data. The photo data we collect is considered sensitive under applicable U.S. and international privacy laws and, as such, is subject to heightened obligations. By using the Services and granting access to your camera roll, you expressly consent to our collection, use, and processing of such data as described in this Privacy Policy. You acknowledge that this processing is necessary to provide the core functionality of the Services. You have the right to withdraw this consent at any time as described in Section 7 (Your Privacy Rights) below, including by revoking camera roll access through your device settings or by requesting account deletion. Withdrawal of consent is prospective only and does not affect the lawfulness of processing conducted prior to your withdrawal. Withdrawal of consent will limit your ability to use certain core features of the Services.
3. SENSITIVE DATA
Certain categories of Personal Information we collect or infer may be considered "sensitive" under applicable U.S. state and international privacy laws and may be subject to heightened legal requirements.

Where required by applicable law, we will provide notice and/or obtain consent prior to processing sensitive data for specified purposes (including disclosure to third-party partners). Given the nature of certain sensitive data categories we may process (including biometric data, precise geolocation, and inferences about race, ethnicity, or sexual orientation), we may provide separate, standalone notice and/or consent mechanisms specific to those categories where legally required, rather than relying solely on this Privacy Policy.
4. HOW WE USE PERSONAL INFORMATION
We use the Personal Information we collect and receive as described below.

To provide and facilitate your engagement with the Services. We may use your Personal Information to record and share your activities so that you can interact with other users, to allow you to explore new events to attend, to share insights with the FanFeed community, and to contact you regarding the Services. We may also use your Personal Information to integrate with third-party services at your request or based on service features, enabling functionality that relies on external platforms.

To generate inferences and profiles. We use the Personal Information we collect (including photo content, metadata, event attendance data, and other information) to generate inferences about your interests, preferences, activities, and characteristics. These inferences are used to provide and improve the Services, to personalize your experience, and to compile data profiles that may be disclosed to third-party partners as described in Section 5.

To communicate with you. We may use your Personal Information to respond to your inquiries, comments, feedback, or questions, and send administrative information to you (for example, information regarding the Services, and changes to our terms, conditions, and policies). We may also send you marketing and promotional communications, including information about products, services, and events that may be of interest to you. If you wish to opt out of marketing communications, you may use the unsubscribe link in any email received from us, or email us with “OPT-OUT,” “UNSUBSCRIBE,” “STOP,” or “REMOVE” in the subject line.

To improve our Services. We may use the Personal Information we collect and receive, including feedback you provide, to conduct research, and to analyze, develop, troubleshoot, increase functionality, and otherwise improve the Services. As our models and data capabilities improve, we may generate additional inferences of the same types previously disclosed from data we have already collected. If we intend to generate materially new categories of inferences, we will provide notice and, where required by applicable law, obtain your consent.

To protect you and the Services. We may use your Personal Information to prevent fraud, criminal activity, or misuse of our Services, and to ensure the security of our IT systems, architecture, and networks. We may also use Personal Information to comply with legal obligations and legal process.

To customize your experience. We may suggest events that may interest you, users that you may want to follow, or new features you may want to try.

For partner-related purposes. We may use Personal Information to compile data packages that may be disclosed to third-party partners for their own marketing, fan engagement, and business intelligence purposes, as described in Section 5. This may include providing financial compensation to us or marketing assets in exchange for data.

5. HOW PERSONAL INFORMATION IS SHARED
We may share Personal Information in accordance with your preferences, as needed to run our business and provide the Services, and where required for legal purposes. The table below describes the circumstances in which we share your Personal Information.

We may receive financial compensation or marketing assets (such as email campaigns or social media posts) in exchange for these data disclosures. Partners are contractually required to: (i) use disclosed Personal Information only for the authorized purposes for which it was disclosed; (ii) handle it in compliance with applicable privacy law, including U.S. state privacy laws and, where applicable, the GDPR and UK GDPR; (iii) implement and maintain appropriate technical and organizational measures to protect the data; (iv) cooperate with applicable deletion requests; (v) not sell, resell, sublicense, or otherwise transfer the data to any third party without FanFeed’s prior written consent; and (vi) promptly notify FanFeed of any actual or suspected breach or unauthorized access involving FanFeed data. To the extent these disclosures constitute a "sale" or "share" of Personal Information under applicable U.S. state privacy laws, we describe your opt-out rights in Section 7 below. |

6. DATA RETENTION
We keep Personal Information for as long as you use the Services or otherwise as authorized under this Privacy Policy, or as reasonably necessary or advisable to fulfill the purpose(s) for which it was collected, provide the Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, protect against fraud, enforce our agreements, and comply with applicable laws.
Please note that all photo information we collect (including photo metadata, photo embeddings, facial vectors, and inferences derived from your photos) is persisted even after you cease using the Services, unless and until you submit a valid deletion request as described in Section 7 below. As our models improve over time, we may generate additional inferences of the same types described in Section 2 from photo data we have already collected. Biometric data (including facial vectors) is subject to a separate biometric data retention schedule, consistent with applicable law. Biometric data will be destroyed when the purpose for which it was collected has been fulfilled or within the period prescribed by applicable law, whichever comes first. In jurisdictions where biometric data retention periods are prescribed by law (including Illinois, Texas, and Washington), we comply with those requirements, which may result in retention and destruction timelines for biometric data that differ from those applicable to general photo data. You may submit a deletion request as described in Section 7 below.
7. YOUR PRIVACY RIGHTS AND CHOICES
Privacy laws provide certain rights to users in certain jurisdictions. Below are rights that may be available to you under applicable laws. To exercise any of these rights, please contact us at privacy@fanfeed.ai. We may verify your identity before processing your request. An authorized agent may submit a request on your behalf; we may require the agent to provide proof of authorization and may also require you to verify your own identity directly with us. We will generally respond to requests within 45 days of receipt. Where additional time is needed, we will notify you of the extension and the reason for the delay.

Access and Portability. You have the right to know, and request access to, the Personal Information we collect, use, share, or otherwise process about you. You can access much of your information by logging into your account. If you require additional access, please contact us.

Right to Rectify, Restrict, and Delete. You have the right to rectify, restrict, or delete Personal Information, including by requesting that we correct where inaccurate, restrict, or delete your Personal Information on your behalf. You may delete your account at any time by following the instructions within the App or by contacting us at privacy@fanfeed.ai. Upon receipt of a valid deletion request: (i) raw photo content will be deleted; (ii) biometric data (facial vectors) will be deleted in accordance with our biometric retention schedule and applicable law; (iii) inferences and derived data will be deleted, subject to any legal retention obligations; (iv) de-identified or aggregated analytical products into which your data has been incorporated may not be capable of individual extraction, and we will assess technical feasibility and delete or de-identify such data to the extent required by applicable law; and (v) to the extent we have already disclosed your Personal Information to a Partner, we will use commercially reasonable efforts to notify the relevant Partner(s) and to limit forward-going disclosure, but we cannot guarantee the return or deletion of data already in a Partner’s possession.

Right to Object. Where we process your information based on our legitimate interests, you can object to this processing under certain circumstances.

Right to Revoke Consent. To the extent we rely on your consent to engage in certain processing, you have the right to withdraw that consent at any time*.* Withdrawing consent does not affect the lawfulness of processing carried out prior to withdrawal.

Right to Opt Out of Sale or Sharing of Personal Information. Under certain U.S. state privacy laws, the disclosure of Personal Information to third-party Partners as described in Section 5 may constitute a "sale" or "share" of Personal Information (including for cross-context behavioral advertising purposes). You have the right to opt out of such sale or sharing. To exercise this right, please contact us at privacy@fanfeed.ai. We do not sell or share the Personal Information of users we know to be under 16 years of age without affirmative authorization.

Right to Non-Discrimination. You have the right not to receive discriminatory treatment for the exercise of your privacy rights. We will not discriminate against you for exercising any of your privacy rights.

Right to Lodge a Complaint. You have the right to lodge a complaint with your applicable data protection authority or, where applicable, your state Attorney General's office.
8. U.S. STATE PRIVACY LAW DISCLOSURES
This section provides additional information for residents of U.S. states with comprehensive privacy laws, including (but not limited to) California, Virginia, Colorado, Connecticut, Texas, and other states with similar laws. We anticipate that our data processing activities will meet the thresholds for applicability under one or more U.S. state privacy laws.
Categories of Personal Information Collected. The types of Personal Information we collect include identifiers (such as name, email, and contact information); internet or other network activity (such as your interactions with the Services); geolocation data (including precise geolocation derived from photo metadata); commercial information (such as ticket purchase history); financial information; electronic information (such as your photos and their associated metadata); biometric information (including facial vectors); and inferences drawn from other Personal Information (including inferences about interests, activities, characteristics, estimated income, estimated location, and broad age category).
Categories of Personal Information Disclosed for a Business Purpose. We may disclose all of the categories of Personal Information listed above to our service providers for business purposes.
Categories of Personal Information Sold or Shared. We may sell or share the following categories of Personal Information with third-party Partners: identifiers (name, email address, phone number); geolocation data (estimated zip code derived from precise photo geolocation); commercial information (event attendance history); inferences about interests, activities, preferences, and characteristics (including estimated income and estimated location); and, subject to further legal review and appropriate notice/consent mechanisms, inferences about sensitive characteristics (see Section 3). We may receive financial compensation or marketing assets in exchange for this data.
Sensitive Personal Information. We process the following categories of sensitive Personal Information: precise geolocation (derived from photo metadata); biometric data (facial vectors); and inferences about characteristics that may constitute sensitive data under applicable law (including race, ethnicity, and sexual orientation). To the extent required by applicable law, we will obtain your consent or provide a mechanism to limit our use of sensitive Personal Information before processing it for purposes beyond those necessary to provide the Services.
Financial Incentive Notice. Access to certain features of the Services is provided free of charge in exchange for your Personal Information, which may constitute a financial incentive or a difference in the price or quality of the Services under the CCPA. The material terms of this arrangement are: (1) the category of Personal Information involved is the Personal Information described in Sections 1 through 3 of this Privacy Policy, including photo data, inferences, and sensitive Personal Information; (2) the value we ascribe to your Personal Information, calculated based on the anticipated revenue generated from disclosures to third-party Partners and the costs of providing the Services, is reasonably related to the value of the Services provided to you free of charge; (3) you may opt in to this arrangement by continuing to use the Services and providing the requested Personal Information; and (4) you may revoke your participation at any time by ceasing use of the Services, adjusting your camera roll and privacy settings, or submitting a deletion or opt-out request as described in Section 7. If you opt out of the sale or sharing of your Personal Information, certain features of the Services that rely on data disclosures to Partners (such as personalized recommendations or Partner-sponsored content) may not be available to you, but your core access to the Services will not be conditioned on participation in data sales or sharing.
Purpose of Sale or Sharing. Personal Information disclosed to Partners is used by those Partners for marketing to fans, enriching their existing customer data profiles, and informing business decisions. FanFeed receives financial compensation or marketing assets (such as email campaigns or social media promotions) in exchange for such disclosures.
Data Subject Requests - California. California privacy rights apply to all individuals (not just registered users). All such individuals who are California residents can request additional information about our privacy practices with respect to their information, as well as make the access, deletion, correction, and opt-out requests described above, by contacting us. Please provide sufficient information that we can identify you, and be aware that we may employ a more extensive authentication process to verify your identity before responding to your request.
"Shine the Light" Disclosure - California. Under California's "Shine the Light" law (Cal. Civ. Code § 1798.83), California residents may request certain information regarding our disclosure of Personal Information to third parties for those third parties' direct marketing purposes during the preceding calendar year, including the categories of Personal Information disclosed and the names and addresses of those third parties. To make such a request, please contact us at privacy@fanfeed.ai.
9. INTERNATIONAL DATA TRANSFERS
FanFeed is based in the United States. If you access the Services from the European Economic Area (EEA), the United Kingdom (UK), Canada, or other regions with data protection laws that differ from U.S. law, please be aware that your Personal Information may be transferred to, stored, and processed in the United States or other jurisdictions. When we transfer Personal Information of individuals in the EEA, Switzerland, or the UK, we will use appropriate legal mechanisms to safeguard the transfer, including Standard Contractual Clauses approved by the European Commission where applicable. We are actively evaluating the scope of our international data processing obligations, including with respect to our intended data disclosure program, and will update this Privacy Policy as our practices evolve.
10. USE OF COOKIES AND TRACKING TECHNOLOGIES
Please note that we use cookies and similar tracking technologies primarily in connection with the FanFeed app. Page views and user interactions are tracked within the app only; we do not use interactions from our website for these tracking purposes.
Third-party vendors, including but not limited to Google, may show advertisements for us on the Internet. Third-party vendors, including but not limited to Google, use cookies to serve advertisements based on your prior access and use of the Services. To opt out of Google's use of cookies and web beacons, you can visit the Google advertising opt-out page available on Google's website.

11. SECURITY
We take reasonable precautions to protect your data, including Personal Information. We maintain administrative, technical, and physical safeguards appropriate to the sensitivity of your information and designed to protect against unauthorized access, disclosures, or access to Personal Information. In the event of a confirmed breach of our systems that compromises your Personal Information, we will notify affected users as required by applicable law. Nonetheless, the transmission of information via the Internet is not completely secure and therefore we cannot guarantee the security of data sent to us electronically, and transmission of such data, including Personal Information, is therefore entirely at your own risk.
12. USERS ONLY OF LEGAL AGE OF MAJORITY
The Services are designed and intended for those who have reached the age of majority (18 years of age). By accessing and using the Services, you affirm that you are at least 18 years of age or older. We are not liable for any damages that may result from a user's misrepresentation of age. We do not knowingly collect, maintain, or use Personal Information from children under 13 years of age, and no parts of our Services are directed to children.
No one under the age of 13 is authorized to submit or post any information, including Personal Information, through the Services. Under no circumstances may anyone under age 13 access or use the Services. If we become aware that a user is under 13, we will immediately terminate the account and delete all associated personal data, including photos, biometric data, and any inferences derived therefrom, within thirty (30) days. We may draw inferences about broad age categories from photo analysis. We do not use these inferences to knowingly facilitate the use of the Services by individuals under 13. We do not sell or share the Personal Information of users we know to be under 16 years of age without affirmative authorization.
Important Terms of Service Provisions. Your use of the Services is also governed by our Terms of Service, which contain provisions that are material to how your Personal Information is handled. In particular: (i) by submitting content to the Services (including photos you grant us access to), you grant FanFeed a non-exclusive, royalty-free, worldwide, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your content for the purposes of providing and improving the Services, generating inferences and analytical outputs, training our models, and disclosing data to Partners as described in this Privacy Policy; (ii) FanFeed owns all right, title, and interest in aggregate analytical products, de-identified work product, and model improvements it generates from your content (“FanFeed Derived Outputs”), although any personal information attributable to you within those outputs remains subject to your data-subject rights under applicable law; (iii) disputes arising under these Terms and this Privacy Policy are subject to mandatory binding arbitration on an individual basis, as described in our Terms of Service; and (iv) where your photos contain images of other individuals, you represent and warrant that you have obtained all necessary permissions and consents from those individuals to allow FanFeed to process their images and biometric information as described in this Privacy Policy and our Terms of Service.
